“Last night my wife and I got into an argument. It got heated and she started hitting me. I grabbed her with force to defend myself and pushed her away, she fell and hit her head. She called 911, so I left the house. When the police arrived she told them that I hurt her. What’s going to happen, now?

Whenever 911 is called regarding a domestic dispute, the female is going to be protected, it is the law. That means that the husband in this case is going to be charged a Class A misdemeanor, ASSAULT-FAMILY MEMBER. However, if chocking was involved, the offense becomes a 3rd degree felony. The domestic laws have been around for a while now. The domestic violence laws in Texas have been written to protect battered women.

So what happens next? The officer will take the complaint and call the District Attorney to see if they will file a charge against the accused. If a charge is filed, a warrant will be issued for the accused arrest. This is practically automatic.
